Terms of Use

1. Acceptance

These terms govern access to and use of the website https://glowmobility.mx (the "site"), operated by Glow Mobility Technologies LLC ("Glow"), a company incorporated in 2024 in Delaware, United States of America, operating commercially in Mexico with regional scope across Latin America.

By accessing the site or using its content, you accept these terms. If you do not agree with them, please do not use the site.

These terms apply to use of the website. They do not govern the delivery of Glow's commercial services, which is governed by a separate agreement if and when one is signed.

2. What the site is

The site is informational. It describes who Glow is, what it is building, and how to reach us. It does not allow accounts to be created, does not process transactions, and does not provide access to the Glow platform.

3. Permitted use

You may read, print, and share the site's content for your own informational purposes or for internal use within your organization, provided you do not alter the content or remove intellectual property notices.

The following is not permitted:

• Using the site for unlawful purposes or in ways contrary to these terms.
• Interfering with the operation of the site, attempting to reach non-public areas or systems, or circumventing its security measures.
• Using automated means of bulk extraction or collection that affect the operation of the site.
• Reproducing, distributing, or commercially exploiting the site's content without Glow's prior written authorization.
• Presenting the site's content as your own, or in a way that suggests a relationship, sponsorship, or endorsement that does not exist.

4. Intellectual property

The content of the site, including text, graphics, images, diagrams, photographs, design, structure, and code, is owned by Glow Mobility Technologies LLC or used with its owner's permission, and is protected by applicable intellectual property law.

The names "Glow" and "Glow Mobility", the logo, and the site's visual identity elements are distinctive marks of Glow Mobility Technologies LLC. Their use requires prior written authorization.

Third-party names, marks, and logos appearing on the site belong to their respective owners and are used solely for identification or reference.

Accessing the site grants no license or right over the content beyond the use permitted in section 3.

5. Accuracy of information and statements about the product

The site's content is published for informational purposes and we make an effort to keep it correct and current, but it may change or become outdated without notice. Glow does not warrant that the information is free of errors or omissions.

The Glow platform is under active development. Descriptions of platform capabilities that are still in development do not constitute a guarantee of availability, of functionality, or of a delivery date.

References to implementation phases, roadmap, future functionality, or expected results are plans and estimates as of the date of publication, not contractual commitments. Actual results may differ.

The operating results described on the site were executed by the founding team before Glow was formed and reflect that team's prior experience. They are presented as background and do not constitute a performance promise by Glow or a guaranteed result for any customer.

Third-party data cited on the site, including references to published electricity tariffs, comes from public sources as of the date consulted and may change. Readers should verify it before making a decision.

Nothing on the site constitutes a binding offer, a quotation, technical, financial, or legal advice, or a contract. Commercial terms are established only in an agreement signed by the parties.

6. Third-party links

The site contains links to sites operated by third parties, including professional profiles and partner pages. Those sites are not under Glow's control. Including a link does not imply endorsement, review, or responsibility for their content, availability, or privacy practices. Use of those sites is governed by their own terms.

7. Email communications

Contact with Glow happens by email. Email is not a secure channel: please do not send confidential information, sensitive personal data, credentials, or financial information through it.

Sending a message does not by itself create a commercial relationship, a confidentiality agreement, or any obligation on Glow's part.

8. Privacy

The handling of personal data collected through the site is described in the Privacy Notice, which forms part of these terms.

9. Availability and changes to the site

Glow may modify, suspend, or discontinue the site or any of its sections at any time, without notice and without liability. Access is not guaranteed to be uninterrupted or error-free.

10. Limitation of liability

The site and its content are made available "as is". To the extent permitted by applicable law, Glow is not liable for direct, indirect, incidental, or consequential damages arising from access to the site, from the inability to access it, or from decisions made on the basis of its content.

The above does not limit liability that cannot be excluded under the law.

11. Changes to these terms

These terms may be updated at any time. The current version is published on the site with its last updated date visible at the top. Continued use of the site after a change constitutes acceptance of the updated terms.

12. Governing law and jurisdiction

These terms are governed by the laws of the United Mexican States. For their interpretation or enforcement, the parties submit to the competent courts of Mexico City, waiving any other jurisdiction that might apply to them.

This does not deprive users of rights granted to them by mandatory law in their place of residence. The handling of personal data is governed in all cases by the LFPDPPP and its Regulations, as set out in the Privacy Notice.
